1. Acceptance of Terms
Welcome to Wint India (accessible via wintindia.com, related portals, and directories, referred to as "the Platform"). By visiting the Platform, initiating tracked business calls, or signing up as a "User", "Merchant", or "Partner", you agree to comply with and be contractually bound by these Terms of Service.
You represent and warrant that you are at least 18 years of age and possess the legal competence and authority to enter into a binding contractual agreement. If you do not accept these terms in their entirety, you are strictly prohibited from using the Platform.
2. Platform Scope & Services
Wint India acts solely as a central telecommunications router, digital matching system, and directory service provider. We do not provide physical contracting services directly.
🛡️ IMPORTANT CLARITY ON PLATFORM LIMITS:
- Independent Merchants: All local business listings, ad campaigns, and professional services are handled independently by third-party Merchants. Wint India does not employ, screen, or legally represent any Merchant.
- Contracts between Users and Merchants: Any quote, booking, call agreement, payment, or physical work is exclusively a direct contract between the consumer and the Merchant. Wint India is not a party to, nor liable for, any merchant interactions or deliverables.
3. Consumer User Obligations
End-users searching for local B2B/B2C services through Wint India agree to:
- Good Faith Inquiries: Provide accurate contact details (phone, email) and refrain from submitting fraudulent, test, or spam quote requests.
- Call Consent: By clicking "Get Quotes" or dialing a trackable lead number on our directory, you explicitly grant consent for matched Merchants to contact you via telephone, email, or SMS.
- No Fee for Searchers: Searching our business directory is free of charge for consumers. You deal directly with merchants regarding service costs.
4. Merchant Portal Rules
Verified businesses accessing the Merchant Centre agree to the following rules:
A. Accuracy & Representation
Merchants must maintain fully accurate details on certifications, operational capabilities, business addresses, hours, and rates. Misleading descriptions are subject to permanent account termination.
B. Call Recording Compliance
Because calls routed through our system may be automatically recorded for quality and lead validation, Merchants must explicitly notify customers in accordance with regional two-party wiretapping laws. You indemnify Wint India against any recording compliance claims.
C. Lead Billing & Disputes
Merchants agree to platform billing metrics (such as pay-per-call, rate cards, or lead subscription models). Any lead dispute (e.g. spam, wrong numbers) must be logged in the merchant dashboard within seven (7) business days to qualify for lead credit.
5. Partner & Referral Terms
Channel Partners or marketing referrers participating in our network are bound by the following commissions rules:
- Referral Tracking: Commissions only accumulate on verified, active merchant accounts registered directly via the Partner's specific affiliate link.
- Payout Schedules: Payments are processed on a monthly net-30 schedule after verifying lead legitimacy and clearing merchant subscription fees.
- Compliance: Partners may not use deceptive advertising, spam emails, or artificial search manipulation to spoof registrations. Doing so results in direct forfeiture of all unpaid balances.
6. Intellectual Property
All Platform designs, custom styles, proprietary source code, database structures, layouts, animations, trademarks, and logos (including the Wint India name and design marks) are the exclusive intellectual property of Wint India and protected by global copyright and trademark laws.
Merchants retain full intellectual property rights to their uploaded logos, copy, and promotional media, but grant Wint India a worldwide, royalty-free license to render and display these assets across our public matching directories.
7. Liability & Disclaimers
THE PLATFORM AND ROUTING SYSTEMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WINT HUB EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING FIT FOR PURPOSE OR MERCHANTABILITY.
🚨 LIMITATION OF DAMAGES:
WINT HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF REVENUE, PROFITS, GOODWILL, OR WORK STOPPAGES) ARISING FROM PLATFORM DOWNTIME, MISLEADING MERCHANT SERVICES, UNSATISFIED CONSUMERS, OR FAULTY ROUTING METRICS.
8. Governing Law & Disputes
These Terms of Service and any contractual disputes arising out of your usage of the Platform shall be governed and interpreted under the laws of the operating country, without regard to conflict of law principles.
Binding Arbitration: Any legal dispute or claim between the parties that cannot be resolved amicably within sixty (60) days shall be resolved exclusively through final and binding arbitration, rather than in court. You explicitly waive any rights to participate in class-action lawsuits or class-wide arbitrations.
